Agreement to These Terms
These Terms of Service form a binding agreement between you and The Bad Alibi Inc. By visiting our website, booking a table or a room, purchasing food or drink, or attending an event at our premises, you accept these terms in full. If you do not accept them, you should not use our website or our services.
Please read this document carefully before you book. It explains what you can expect from us and what we expect from you, including how payments, cancellations, conduct and liability are handled. The developer, Bad Alibiy, maintains the technical environment in which these terms are published, while the conduct of the business remains the responsibility of The Bad Alibi Inc.
Where you act on behalf of a company or another person, you confirm that you have authority to accept these terms for that party. In that case, the party you represent is bound by the agreement alongside you, and a reference to you includes that party where the context requires it.

References in these terms to we, us and our mean The Bad Alibi Inc. References to you mean the visitor, guest, customer or party that accepts this agreement. References to the house mean our premises and the services we provide there, including the bar, the kitchen, the stage and the coat check.
We may describe services such as private event bookings, our craft beer and tap program, cocktail bar service, live music nights, our pub kitchen and menus, and corporate gatherings. Those descriptions are provided in good faith, and the exact offering on a given date may vary with season, supply and staffing.
Eligibility and Age
Our public house serves alcoholic drinks to adults. By ordering alcohol, you confirm that you are of legal drinking age in Ontario and that you can produce valid government identification on request. We will refuse service to anyone who cannot show acceptable identification, and we do so without exception.
Younger guests may be welcome at certain family-friendly hours and private events when accompanied by a responsible adult. The rules for any given event are confirmed at the time of booking. Where a private event is designed around alcohol, the organiser is expected to make the nature of the event clear to invited guests.
If a booking is made by someone under the age of majority, we may cancel it and refund any amount paid, minus costs we have already incurred. We may also refuse entry where we believe the age rules are being evaded, and we cooperate fully with licensing authorities.
Use of This Website
We provide this website so that people can learn about our public house, see our services and contact us about bookings. You may browse the site and use it for those purposes. You may not interfere with its operation, attempt to gain unauthorised access to its systems or use it in a way that harms us or other visitors.
The content on the site is provided for general information. Menus, opening hours and event details may change, and we do not guarantee that every page is current at every moment. Where a detail matters to you, please confirm it with us directly before you rely on it.
We work to keep the site available and secure, but we cannot promise uninterrupted service. We may suspend the site for maintenance, updates or reasons beyond our control, and we are not liable for any inconvenience that results from a temporary interruption.
Bookings and Reservations
A booking begins with your enquiry and is confirmed by us in writing. Until we send that confirmation, a proposed date is not reserved. We may hold a date for a short period while details are discussed, and we will tell you when that hold expires so that you can decide.
When you book, you agree to give accurate information about your party, including the number of guests, any dietary needs and any accessibility requirements. If your numbers change significantly, tell us as soon as you can, because the room layout, the menu and the staffing plan may need to adjust.
We may decline a booking for any lawful reason, including where the requested event would exceed the safe capacity of the room, conflict with another commitment or raise a concern about safety or licensing compliance. If we decline and you have paid a deposit, we will return it in line with our cancellation rules.
Deposits, Payments and Pricing
Private events normally require a deposit to confirm the date and a final payment before or on the day of the event. We will set out the amounts, the due dates and the methods of payment in your booking confirmation. We may require a minimum spend for certain rooms or times, and we will always explain that clearly before you commit.
Prices are quoted in Canadian dollars and may change over time. The price that applies to your booking is the one stated in your confirmation, subject to any agreed adjustment for changes you request. Taxes are applied where required, and any gratuity is either included as stated or left to your discretion.
If a payment is late or a card is declined, we may treat the booking as at risk and contact you to resolve the matter. If it remains unresolved, we may release the date and apply our cancellation terms. We do not store full card numbers on our systems, and card payments are handled by regulated processors.
Cancellations and Changes
Plans change, and we try to be reasonable when they do. Our cancellation terms depend on how close to the event the change is made and on the costs we have already committed. A deposit may be non-refundable once a date is confirmed, because we turn away other bookings to hold it for you.
If you cancel with plenty of notice, we may offer to move the booking to a new date instead of keeping the deposit, subject to availability. If you cancel at short notice, we may retain all or part of the deposit and charge for costs already incurred, such as ordered stock, booked entertainment or scheduled staff.
If we must cancel a booking for a reason within our control, we will return your deposit and any payment for the cancelled service, and we will help you find an alternative date if you wish. If a circumstance beyond our control makes an event impossible, we will discuss a fair outcome with you in good faith.
Private Events and Buyouts
A private event or buyout gives you use of a defined space for an agreed period. The scope of that space, the access times and any shared areas are recorded in your booking confirmation. You are responsible for your guests during the booking and for making sure they respect the house and its staff.
You may wish to bring in decorations, entertainment or outside suppliers. Please discuss this with us in advance, because some items are not suitable for the building and some suppliers need to be scheduled around our operations. We may refuse an item that creates a safety risk or that would disturb the room.
A named host from our team will run the evening with you. That host keeps the plan on track, manages the bar and kitchen timing and deals with any issue that arises. Decisions about service and safety at the house remain with our team, even during your event.
Menus, Food and Drink
Our kitchen and bar prepare food and drink from a seasonal menu. We describe dishes and drinks as accurately as we can, but we cannot guarantee that every item is free from every allergen, because our kitchen handles a wide range of ingredients. Always tell us about allergies and intolerances when you book or order.
Menu items may change with supply, season and demand. If an item you expected is unavailable, we will offer a suitable alternative and explain the change. For private events we will agree a menu in advance and confirm any substitution with you before the event where time allows.
You agree not to bring your own food or drink into the house without our written agreement. Where we allow it, for example for a celebration cake, we may charge a service fee and we accept no responsibility for the safety or provenance of the item you supply.
Responsible Service of Alcohol
We are committed to the responsible service of alcohol. Our staff are trained to recognise when a guest has had enough, and they have the authority and the duty to refuse service. We may also ask a guest to leave and to arrange safe transport home. This is not personal; it is how a responsible house operates.
We will not serve anyone who appears to be intoxicated, who cannot show valid identification when asked, or who is buying for someone who should not be served. We take these duties seriously because they protect our guests, our team and our licence.
Guests are encouraged to plan their journey home in advance. Our team can call a taxi, point you to public transit or help you contact a friend. Please do not drive if you have been drinking, and please do not press our staff to serve you against their judgement.
Conduct at the House
The Bad Alibi Inc. is a place for good company. We expect guests to treat each other, our team and the premises with respect. Conduct that endangers others, damages property or spoils the evening for other guests is not acceptable and may lead to removal from the house.
We do not tolerate violence, threats, harassment or discrimination of any kind. Any guest who behaves in that way will be asked to leave and may be refused entry in future. Where the law has been broken, we will involve the police and cooperate fully with any investigation.
Smoking, including vaping, is not permitted inside the building. It is allowed only in designated outdoor areas, where local rules apply. Please respect our neighbours when you are outside, especially late in the evening, because the house sits within a residential community.
Live Music and Entertainment
We host live music nights and other entertainment from time to time. The schedule may change, and an act may be replaced or a performance rescheduled for reasons that include illness or technical difficulty. We will let you know about a change where we can, and entry to a music night does not guarantee that a named act will perform at a precise time.
Where a ticket or cover charge applies, the terms of that specific event are set out at the point of sale and form part of these terms. Unless stated otherwise, tickets are non-refundable, but we may allow you to transfer a ticket to another person if you tell us in advance.
Musicians and performers who play at the house are independent professionals. We book them carefully, but we are not responsible for the content of their performance or for any view they express. If a performance raises a concern for you, please speak to a member of our team.
Coat Check and Personal Property
Our coat check is offered as a courtesy to guests. We take reasonable care of items left with us, and the brass hooks and numbered tags are there to keep things organised. Even so, you leave personal property at the house at your own risk, and we recommend that you keep valuables with you.
We are not responsible for loss or damage to personal property unless the loss or damage results from our negligence. If something goes missing, tell us as soon as possible so that we can check the coat check and review what happened. Items left behind are kept for a limited period and then disposed of responsibly.
Where we agree to store equipment, instruments or event materials for a booking, the arrangement and any conditions will be recorded in your confirmation. Unless we agree otherwise, such items remain your responsibility throughout.
Accessibility and Special Needs
We want every guest to enjoy the house. If you have a mobility, sensory, dietary or other need, please tell us when you book so that we can plan the room, the seating and the service around you. We will be honest about what the building can and cannot accommodate.
Where a reasonable adjustment would help you, we will make it if we can. That might mean a different table, a quieter area, a printed rather than spoken menu or extra time during service. We treat every request with respect and discretion.
If you arrive without having told us about a need, we will still do our best. Letting us know in advance simply gives us the best chance to get it right, and it helps us keep the evening smooth for everyone.
Intellectual Property
The content of this website, including text, layout, graphics and the distinctive back bar design, belongs to The Bad Alibi Inc. or is used with permission. You may view and print pages for your own personal use, but you may not copy, republish or sell the content without our written consent.
Our name, our roundel and any related marks are our property. Nothing in these terms grants you a licence to use them. If you would like to reference the house in an article, a review or a partnership, please contact us first so that we can agree the details.
Any material you send us, such as a photograph or a comment, remains yours, but you grant us permission to use it in connection with the house unless you tell us otherwise. We will always respect a request to remove your material from our channels.
Acceptable Use and Prohibited Acts
When using our website or visiting the house, you agree not to act unlawfully or in a way that harms others. Prohibited acts include attempting to breach our security, transmitting malicious code, scraping our content at scale, impersonating our staff or guests, and using our premises for an unlawful purpose.
You also agree not to bring prohibited items onto the premises, not to consume outside alcohol in breach of licensing rules, and not to interfere with our equipment or fittings. Where damage is caused deliberately or through reckless behaviour, we may recover the cost of repair from the responsible party.
If you become aware of any misuse of our website or our services, please report it to us using the contact details at the end of these terms. We take reports seriously and will investigate promptly.
Gift Cards and Vouchers
We may issue gift cards, vouchers or credits from time to time. Unless the card or voucher states otherwise, it can be used towards food and drink at the house and towards eligible bookings. It cannot be exchanged for cash and it is not transferable for value outside the house.
Gift cards and vouchers have an expiry period that is stated when they are issued and that complies with applicable law. Please keep the card safe, because we may not be able to replace it if it is lost. Where a promotional credit is issued, its own conditions apply and will be explained at the time.
If you have a question about the balance or validity of a card or voucher, contact us with the reference number and we will check our records. We will always apply the terms that applied when the card was issued.
Liability and Disclaimers
We provide our services with reasonable care and skill. To the extent permitted by law, we exclude implied terms that we cannot justify and we limit our liability for indirect or consequential loss. Nothing in these terms excludes liability that the law does not allow us to exclude.
Our website is provided as it is. We do not promise that it will always be available, free of errors or free of harmful components. You use the site at your own discretion, and you are responsible for the security of your own device and connection.
Where liability cannot be excluded, our total liability to you for a claim connected with a booking is limited to the amount you paid us for the service in question. This limitation does not apply to death or personal injury caused by our negligence or to any other liability that the law requires us to carry.
Indemnity
You agree to indemnify The Bad Alibi Inc. against claims, losses and costs that arise from your breach of these terms, from your misuse of our website or premises, or from the conduct of your guests during a booking. This indemnity applies to the extent that the claim results from your act or omission.
Where a claim is made against us, we will tell you promptly and give you the chance to respond. We will cooperate with you in defending the claim, but we retain the right to choose our own legal representation and to settle on terms that protect our interests.
This obligation does not apply where the loss results from our own negligence or from something outside your control. It exists so that responsibility is placed where it belongs when a guest or organiser causes harm through their own choices.
Suspension and Refusal of Service
We reserve the right to refuse service, to end a booking or to remove a guest where we believe it is necessary for safety, for legal compliance or for the comfort of others. A decision of this kind is made carefully and, where possible, is explained to the person affected.
If we end a booking because of a serious breach of these terms, we may retain payments to cover our costs and we may decline future bookings from the same party. If we end a booking for a reason that is not your fault, we will settle the account fairly and return any amount due.
We also reserve the right to restrict access to our website where we detect abusive behaviour, such as attempts to attack our systems or to harvest data at scale. Such restrictions protect all of our visitors and the integrity of our services.
Governing Law and Disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute that cannot be resolved informally will be dealt with by the courts of Ontario, and both parties accept the jurisdiction of those courts.
Before beginning formal proceedings, we ask that you contact us so that we can try to resolve the matter directly. Many concerns are settled quickly through a conversation, and we would rather find a fair answer than spend time in a dispute.
If a provision of these terms is found to be unenforceable, the rest of the agreement remains in force. The remaining provisions continue to apply as though the unenforceable provision had been removed, and the agreement as a whole continues to reflect the intention of the parties.
Changes to These Terms
We may update these terms from time to time to reflect changes in our services, our technology or the law. When we make a material change, we will update the date at the foot of this page and, where the change is significant, we will give a clearer notice on the website or by email.
The version that applies to your booking is the version in force when the booking is confirmed, unless a change is required by law or by a safety concern. If you continue to use our website or services after an update, you accept the revised terms.
We keep earlier versions on file so that we can show what applied at a given time. If any part of a revision is unclear to you, please contact us and we will explain how it affects your situation.
